“The Obama Administration’s disregard for the law has struck again,” The Heritage Foundation’s Hans von Spakovsky and Amy Payne write in today’s Morning Bell. “And this time, it’s encouraging others to violate the law at taxpayer expense.”

That’s worth saying again: The Obama Administration is encouraging people to violate a law, and promising that it will use taxpayer money to cover fines incurred from this action.

The law: The law in question is called the WARN Act, and it requires that federal contractors send employees layoff notices 60 days before a plant closing or mass layoff.

The inconvenience: Massive defense spending cuts under sequestration are scheduled to hit on January 2, 2013. Defense contractors affected by the budget cuts would have to issue notice letters to employees by November 2 (four days before the election) to meet the January 2 start date for the spending cuts.

The penalty taxpayers would pay: Employers who violate the WARN Act are liable to their former employees for “back pay for each day of a violation” and “benefits under an employee benefit plan,” as well as a penalty of $500 for each day that notice has not been sent to the local government where the layoffs will occur.

Where are the particulars about the administrations offer to cover violating businesses. This article, if I read it correctly, does not give any particulars about the offer.

It is strange that this President can manipulate laws, reguiations any way that is convenient for him and Congress is not even considered. I know we have Reps and Senators but they can’t seem to stop his “ruling” administration. Hmmmm!

Similar to the Obamacare legislation, this administration sets up procedures to allow their friends, Democrats and donars to violate the law and issue exemptions to those that do. Just another example of the Dictator that Obama is.

When is the President’s disregard of the law and the Constitution going to be challenged? So far I see no response from the legistative bodies as he ignores or totally disregards laws the Congress has passed and which by the Constitution he is bound to uphold.

Here’s what I wrote to my Congressman and Senators, in part:
This is an absolute outrageous abuse of power by a non-elected bureaucrat! If CAGW is correct, then OMB Director Zients is ordering government contractors to violate the law, and promising that the taxpayers will foot the bill for any legal actions brought against the contractors!

It would seem to me that Zients would then be an accomplice to illegal acts. Please advise me why he shouldn’t be prosecuted to the full extent of the law, assuming that President Obama loses the election (his DoJ would refuse to take on this task, I’m sure.)

Is Congress going to stand idly by and continue to allow the Executive branch violate the law without penalty? If so, I know how we could save money–give pink slips to the 535 members of the House and Senate that continue to allow the administration to ride rough-shod over them.
